In recent years, the battle over “junk science” used in wrongful convictions has accelerated. For example, the Innocence Project at the Cardozo School of Law in New York City found that forensic evidence was misused in nearly half of the 350 cases in which DNA was used to help exonerate wrongly convicted defendants.

The experienced state and federal criminal lawyers of Schwartz & Posnock have been challenging the government’s forensic evidence and winning acquittals for our clients in science based prosecutions for over 30 years.

The United States Justice Department is attempting to rebuild faltering confidence in forensic science and how its experts describe their findings in court. The Justice Department has created an internal team, led by a former state prosecutor, to monitor the accuracy of forensic testimony in criminal cases.

The Justice Department will now establish a forensic science working group which will set uniform standards for how experts testify about such evidence. Further, it will create a program to monitor the accuracy of forensic testimony. The group will also conduct a broad look at the personnel and equipment needs of the nation’s overburdened crime labs.
